A dispute with a neighbour can become quite stressful and costly if they are not resolved promptly. 

With all neighbour disputes it is advisable that you first attempt to discuss the issues in an amicable manner directly with your neighbour, or if you do not feel able to speak with your neighbour directly, then you may consider writing a letter to them. You should only resort to legal action if all attempts to reach agreement with your neighbour fail.

Disputes between neighbours can arise for a variety of reasons including the following:
  • Trees or shrubs overhanging into your garden
  • Neighbours trespassing over onto your property 
  • Works encroaching over onto your property on the ground or in the air
  • Disputes over rights of way
  • Disputes over the location of a new fence
  • Disputes over the maintenance and/or replacement of jointly shared fences or hedges
  • Disputes over parking arrangements  
  • Disputes over access to a neighbour’s property to undertake maintenance on your own property
  • Disputes over construction works and Party Wall Act Notices. 
  • Breach of property covenants
  • Excessive noise complaints
  • Breach of privacy
